Provides for the issuance of free passes, cards, or badges for racetracks to any qualified person, as deemed appropriate by the operator of the racetrack, subject to the rules of the state racing and wagering board; authorizes the issuance of such passes, cards or badges to the general public as part of a promotion or marketing program to increase attendance at live race meets.

AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to free passes, cards or badges
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 243 of the racing, pari-mutuel wagering and breed-
2 ing law, as amended by chapter 18 of the laws of 2008, is amended to
3 read as follows:
4 § 243. Free passes, cards or badges. A corporation licensed or fran-
5 chised to conduct pari-mutuel betting on races run on its racetrack[,
6 shall not] may issue free passes, cards or badges [except] to [persons
7 hereafter described: officers] any qualified person. Qualified person
8 shall include, but not be limited to, officers and employees of the
9 corporation conducting the race meeting, members, officers and employees
10 of the state racing and wagering board, members and employees of the
11 jockey club, members and employees of the national steeplechase and hunt
12 association, members of turf organizations of other states and foreign
13 countries, public officers engaged in the performance of their duties,
14 persons actually employed and accredited by the press to attend such
15 meetings, owners, stable managers, trainers, jockeys, jockey managers,
16 grooms, concessionaires, spouses, domestic partners and children of
17 owners, trainers and jockeys, [and] other persons whose actual duties
18 require their presence at such racetrack, and any other person or guest
19 deemed appropriate by such corporation. In addition, free passes, cards
20 or badges may be issued to the general public in connection with any
21 promotional campaign or marketing program sponsored by such corporation
22 to increase attendance at live race meets. The issuance of free passes,
23 cards or badges shall be under the rules and regulations of the state
24 racing and wagering board [and a list of all persons to whom free pass-

3 § 2. Section 324 of the racing, pari-mutuel wagering and breeding law
4 is amended to read as follows:
5 § 324. Free passes, cards or badges. A corporation or association
6 licensed to conduct pari-mutuel betting on harness horse races run at
7 its racetrack [shall not] may issue free passes, cards or badges
8 [except] to [persons hereafter described: officers] any qualified
9 person. Qualified person shall include, but not be limited to, officers
10 and employees of the corporation or association conducting the race
11 meeting, members, officers, and employees of the state racing and wager-
12 ing board, members of harness racing associations of other states and
13 foreign countries, public officers engaged in the performance of their
14 duties, persons actually employed and accredited by the press to attend
15 such meetings, owners, stable managers, trainers, drivers, concessio-
16 naires [and], spouses, domestic partners and children of owners, train-
17 ers and jockeys, other persons whose actual duties require their pres-
18 ence at such racetrack, and any other person or guest deemed appropriate
19 by such corporation or association. In addition, free passes, cards or
20 badges may be issued to the general public in connection with any promo-
21 tional campaign or marketing program sponsored by such corporation or
22 association to increase attendance at live race meets. The issuance of
23 free passes, cards or badges shall be under the rules and regulations of
24 the state racing and wagering board [and a list of all persons to whom
25 free passes, cards or badges are issued shall be filed with the state
26 racing and wagering board].
27 § 3. Section 422 of the racing, pari-mutuel wagering and breeding law
28 is amended to read as follows:
29 § 422. Free passes, cards or badges. A corporation or association
30 licensed to conduct pari-mutuel betting on quarter horse races run at
31 its racetrack [shall] may issue free passes, cards or badges to [persons
32 hereafter described: officers] any qualified person. Qualified person
33 shall include, but not be limited to, officers and employees of the
34 corporation or association conducting the race meeting, members, offi-
35 cers, and employees of the state racing and wagering board, members of
36 quarter horse racing associations of other states and foreign countries,
37 public officers engaged in the performance of their duties, persons
38 actually employed and accredited by the press to attend such meetings,
39 owners, stable managers, trainers, jockeys, concessionaires [and],
40 spouses, domestic partners and children of owners, trainers and jockeys,
41 other persons whose actual duties require their presence at such race-
42 track, and any other person or guest deemed appropriate by such corpo-
43 ration or association. In addition, free passes, cards or badges may be
44 issued to the general public in connection with any promotional campaign
45 or marketing program sponsored by such corporation or association to
46 increase attendance at live race meets. The issuance of free passes,
47 cards or badges shall be under the rules and regulations of the state
