        AN ACT to amend the labor law, in relation to the  project  notification
          fee imposed for asbestos removal
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 904 of the labor law is amended by adding  two  new
     2  subdivisions 2-a and 2-b to read as follows:
     3    2-a.  The  project notification fee imposed by subdivision two of this
     4  section shall be waived if the project is  being  undertaken  by  or  on
     5  behalf  of a city, town, village, or county that is abating or demolish-
     6  ing a building that is a public nuisance or unsafe.  Such  waiver  shall
     7  apply  only  if  the  city, town, village or county certifies in writing
     8  that the project cost will exceed the resulting value of the property.
     9    2-b. The project notification fee imposed by subdivision two  of  this

    10  section shall be waived if the project is being undertaken: (a) pursuant
    11  to  a  plan adopted pursuant to article fifteen of the general municipal
    12  law; (b) pursuant to a plan adopted pursuant to  article  eighteen-C  of
    13  the general municipal law; or (c) by or on behalf of a land bank operat-
    14  ing pursuant to article sixteen of the not-for-profit corporation law.
    15    § 2. This act shall take effect immediately.
