        AN ACT to amend the parks, recreation and historic preservation law,  in
          relation  to requiring a solar powered trash compacting garbage recep-
          tacle pilot program
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  parks,  recreation  and historic preservation law is
     2  amended by adding a new section 3.27 to read as follows:
     3    § 3.27 Purchasing for solar powered trash compacting garbage  recepta-

     4  cles.  1.  As  used  in  this  section,  "solar powered trash compacting
     5  garbage receptacle" shall mean a  trash  receptacle  that  utilizes  the
     6  sun's natural energy to automatically drive a compactor with an enclosed
     7  system  in  the same footprint that is equipped with wireless technology
     8  to monitor real-time waste levels.
     9    2. a. The commissioner shall undertake a solar powered trash  compact-
    10  ing  garbage  receptacle  pilot  project  and  shall replace one hundred
    11  garbage receptacles with solar powered trash compacting receptacles. The
    12  commissioner shall place solar powered trash compacting  receptacles  in
    13  Niagara  Falls  State Park, Riverbank State Park, Roberto Clemente State

    14  Park and Sunken Meadow State Park. The commissioner shall  allocate  the
    15  number of receptacles in each such park at his or her own discretion.

     1    b.  The commissioner shall sell to any individual, partnership, corpo-
     2  ration or other business entity advertising space on such solar  powered
     3  trash  compacting  garbage  receptacles;  provided,  however,  that  the
     4  commissioner shall not purchase  such  solar  powered  trash  compacting
     5  garbage  receptacles before he or she has received payments in consider-

     6  ation for such advertising space.
     7    3. The commissioner shall submit to the governor, the speaker  of  the
     8  assembly,  the temporary president of the senate, the chair of the tour-
     9  ism, parks, arts and sports development committee in the  assembly,  the
    10  ranking  minority member of the tourism, parks, arts and sports develop-
    11  ment committee in the assembly, the chair of the cultural affairs, tour-
    12  ism, parks and recreation committee in the senate, the ranking  minority
    13  member  of the cultural affairs, tourism, parks and recreation committee
    14  in the senate, the chair of the environmental conservation committee  in
    15  the assembly, the ranking minority member of the environmental conserva-

    16  tion committee in the assembly, the chair of the environmental conserva-
    17  tion  committee  in the senate, the ranking minority member of the envi-
    18  ronmental conservation committee in the senate, and  the  chair  of  the
    19  renewable  energy  subcommittee  in the assembly, a report detailing the
    20  program, including but not limited to:
    21    a. the number of operating  solar  powered  trash  compacting  garbage
    22  receptacles;
    23    b. the total number of weekly collections for each receptacle;
    24    c. the man hours used to collect waste from each receptacle;
    25    d. fuel usage for such collection; and
    26    e.  the  estimated  amount  of carbon dioxide reduction as a result of
    27  this program.
    28    § 2. This act shall take effect immediately.
