        Introduced  by  Sen. BONACIC -- read twice and ordered printed, and when
          printed to be committed to the Committee on Commerce, Economic  Devel-
          opment and Small Business -- recommitted to the Committee on Commerce,
          Economic Development and Small Business in accordance with Senate Rule
          6,  sec. 8 -- reported favorably from said committee, ordered to first
          and second report, ordered to a third  reading,  amended  and  ordered

        AN  ACT  to  amend  the alcoholic beverage control law, in relation to a
          license to sell liquor at retail for consumption on certain premises
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
     2  control law is amended by adding a  new  paragraph  (e-10)  to  read  as
     3  follows:
     4    (e-10)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a  premises  which shall be located within two hundred
     7  feet of a building occupied exclusively as a church, synagogue, or other
     8  place of worship, provided such premises constitutes a premises for  the
     9  sale  of  food  or  beverages  at retail for consumption on the premises
    10  located wholly within the boundaries of the county  of  Ulster,  bounded
    11  and described as follows:
    12    ALL  that  piece  or parcel of land, situated in the Village of Ellen-
    13  ville, Town of Wawarsing, County  of  Ulster  and  State  of  New  York,
    14  described as follows:
    15    BEGINNING  at  a  point  in the northeasterly line of Canal St. at its
    16  intersection with the southeasterly line of Hermance St, said point also
    17  being the most westerly corner of lands herein described:
    18    RUNNING THENCE along the southeasterly line of Hermance Street,  North
    19  44  degrees  57  minutes 27 seconds East, a distance of 105.52 feet to a
    20  point being the most westerly quarter of lands now  or  formerly  Sequi,
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  Liber  1885  at page 56, said point also being the most northerly corner
     2  of lands herein described;
     3    THENCE  along the southwesterly line now or formerly Segui, and gener-
     4  ally following a wood fence a portion of the way, south  44  degrees  55
     5  minutes  42  seconds  east,  a  distance of 89.54 feet to a point in the
     6  northerly line of lands now or formerly Hosanna Assemblies of God, Inc.,
     7  said point also being an easterly corner of land herein described;
     8    THENCE along the northerly line and westerly  line  of  lands  now  or
     9  formerly  Hosanna  Assemblies  of  God,  Inc,  the following corners and
    10  distances; South 45 degrees 59 minutes 54 seconds  west  a  distance  of
    11  4.45 Feet and South 44 degrees 09 minutes 41 seconds East, a distance of
    12  5.72 feet to a point being an easterly corner of lands herein described;
    13    THENCE along a northerly line of lands now and formerly Hosanna Assem-
    14  blies of God, Inc, a portion of the way lands now and formerly Tchaikov-
    15  sky, et al, South 45 degrees 50 minutes 19 seconds West, passing through
    16  a  found  iron  rod  at a distance of 2.10 Feet and continuing along the
    17  northwesterly line of lands now and formerly Tchaikovsky et  al,  100.16
    18  Feet  for  a  total  distance  of  102.26  feet to a found x-chiseled in
    19  concrete walk and being in the northeasterly line  of  Canal  St.,  said
    20  point also being the most southerly corner of land herein described;
    21    THENCE  along the northeasterly line of Canal St., North 44 degrees 09
    22  minutes 41 seconds West, a distance of 93.69 Feet to the point or  place
    23  of BEGINNING.
    24    Containing 0.229 acres of land.
    25    Being  and  intended  to  be  the  same  premises by deed from Lane A.
    26  Kleinman to Lane A. Kleinman and Caroline E.  Kleinman  dated  September
    27  16,  1999  recorder  in the Ulster County Clerks Office in Liber 2967 at
    28  page 93.
    29    § 2. This act shall take effect immediately.
