Establishes the "office of the caregiving economy", for the purpose of promoting and supporting the state's caregiving needs by developing the caregiving economy in the state.

AN ACT to amend the economic development law, in relation to establish-
ing the office of the caregiving economy
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The economic development law is amended by adding a new
2 article 4-D to read as follows:

5 Section 147. Definitions.
6 147-a. Office of the caregiving economy established.
7 147-b. Director and employees of the office.
8 147-c. Powers and duties of the office.
9 § 147. Definitions. As used in this article, the following terms shall
10 have the following meanings:
11 1. "Office" shall mean the office of the caregiving economy estab-
12 lished pursuant to section one hundred forty-seven-a of this article.
13 2. "Director" shall mean the director of the caregiving economy
14 appointed pursuant to section one hundred forty-seven-b of this article.
15 3. "Caregiving economy" shall mean and include the industry of direct
16 care, home care, child care, adult care, private and non-profit residen-
17 tial health care facilities as defined by section twenty-eight hundred
18 one of the public health law, family caregivers, and other entities as
19 determined by the director that support formal and informal caregiving.
20 § 147-a. Office of the caregiving economy established. There is hereby
21 established within the department an office of the caregiving economy
22 for the purpose of promoting and supporting the state's caregiving needs
23 by developing the caregiving economy in the state.

1 § 147-b. Director and employees of the office. The head of the office
2 shall be the director of the caregiving economy, who shall be appointed
3 by the commissioner, and who shall have expertise and experience in the
4 caregiving economy. The commissioner may appoint such officers and
5 employees having experience in the caregiving industry, including indi-
6 viduals with experience working with organized labor organizations and
7 informal caregivers, as the commissioner may deem necessary to carry out
8 the provisions of this article and prescribe their duties.
9 § 147-c. Powers and duties of the office. 1. The office shall have the
10 power to:
11 (a) Advise the commissioner on incorporating caregiving into the
12 department's mission, with the goal of making support for the caregiving
13 economy a fundamental principle of the state's economic development
14 approach, including but not limited to, implementing the provisions of
15 section eleven of this chapter, providing solutions to any relevant
16 findings of the reimagining long-term care task force established pursu-
17 ant to chapter seven hundred fifty-eight of the laws of two thousand
18 twenty-one, and ensuring robust funding opportunities for caregiving
19 economy projects;
20 (b) Ensure that caregiving economy careers are included as part of all
21 appropriate workforce development efforts undertaken by the department,
22 including developing materials to help jobseekers learn more about such
23 careers, programming to include jobseekers in all outreach by the
24 department, and training for department staff to keep jobseekers up-to-
25 date on career options;
26 (c) Work with organized labor and other stakeholders to ensure that
27 careers in the caregiving economy are sufficiently funded and supported;
28 (d) Encourage innovation in the caregiving economy, including but not
29 limited to, models for delivering services and sustainable approaches to
30 long-term care;
31 (e) Conduct research on the reach and value of the caregiving economy
32 in New York state, including but not limited to gathering data on the
33 individuals served by each sector of the caregiving economy, and any
34 areas of the state having a population that is underserved by the exist-
35 ing caregiving economy; and
36 (f) Coordinate the department's duties under subdivision fifty of
37 section one hundred of this chapter.
38 2. On or before January thirty-first of each year, the office shall
39 submit an annual report to the temporary president of the senate and the
40 speaker of the assembly detailing the economic impact of formal and
41 informal caregiving on the state, and any savings achieved by public
42 investment in the caregiving economy.
43 § 2. Section 100 of the economic development law is amended by adding
44 a new subdivision 50 to read as follows:
45 50. to promote and support the caregiving economy, as defined by
46 section one hundred forty-seven of this chapter, in New York state,
47 including but not limited to, workforce development supporting existing
48 caregiving providers, and attracting new caregiving providers into the
49 state's caregiving economy.
50 § 3. This act shall take effect on the ninetieth day after it shall
51 have become a law. Effective immediately, the addition, amendment and/or
52 repeal of any rule or regulation necessary for the implementation of
53 this act on its effective date are authorized to be made and completed
54 on or before such effective date.
