        AN ACT to amend the executive law, in relation to limitations on certain
          excess property provided to local law enforcement

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 837 of the executive law is amended by adding a new
     2  subdivision 23 to read as follows:
     3    23. (a) Prohibit a law enforcement agency from receiving or purchasing
     4  the following property from a military equipment surplus  program  oper-
     5  ated by the federal government:
     6    (i) drones that are armored, weaponized, or both;
     7    (ii) aircraft that are combat configured or combat coded;
     8    (iii) grenades or similar explosives and grenade launchers;
     9    (iv) silencers;
    10    (v) militarized armored vehicles;
    11    (vi) camouflage uniforms;
    12    (vii) bayonets;
    13    (viii) riot gear including batons, helmets, and shields;
    14    (ix) firearms or ammunition;
    15    (x) explosives or pyrotechnics; or
    16    (xi) chemical incapacitants.
    17    (b)  For  purposes of this subdivision, "law enforcement agency" means
    18  any agency which is empowered by law to conduct an investigation  or  to
    19  make  an  arrest for a felony, and any agency which is authorized by law
    20  to prosecute or participate in the prosecution of a felony.
    21    (c) If a law enforcement agency  requests  property  from  a  military
    22  equipment  surplus  program,  the law enforcement agency shall publish a
    23  notice of the request on its publicly accessible website within fourteen
    24  days after such request.
    25    § 2. This act shall take effect immediately.
