AN ACT to amend the public authorities law and the economic development
law, in relation to requiring public corporations and agencies to
provide written notice to each minority- or women-owned business
enterprise that unsuccessfully bid on a contract of the reason or
reasons why the business enterprise was unsuccessful in obtaining the
contract
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Clause IV of subparagraph (H) of paragraph (j) of subdivi-
2 sion 3 of section 2879 of the public authorities law, as added by chap-
3 ter 174 of the laws of 2010, is amended and a new subparagraph (I) is
4 added to read as follows:
5 IV. consult the most recent disparity study pursuant to article
6 fifteen-A of the executive law[.]; and
7 (I) A requirement that, within thirty days of the awarding of a
8 contract, the corporation awarding the contract provide written notice
9 to each minority- or women-owned business enterprise that unsuccessfully
10 bid on the contract of the reason or reasons why the business enterprise
11 was unsuccessful in obtaining the contract.
12 § 2. Section 143 of the economic development law is amended by adding
13 a new subdivision 6 to read as follows:

1 6. Within thirty days of the awarding of a contract, the agency award-
2 ing the contract shall provide written notice to each minority- or
3 women-owned business enterprise that unsuccessfully bid on the contract
4 of the reason or reasons why the business enterprise was unsuccessful in
5 obtaining the contract.
6 § 3. This act shall take effect on the ninetieth day after it shall
7 have become a law.
