AN ACT to amend the agriculture and markets law, in relation to the
reimbursement of schools for purchasing New York farm products
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 16 of the agriculture and markets law is amended by
2 adding a new subdivision 5-d to read as follows:
3 5-d. The commissioner of education shall reimburse school nutrition
4 programs at an additional rate based on the percentage that New York
5 farm products constitute of each program's food purchases in a school
6 year. Schools for which New York farm products constitute at least ten
7 percent of food purchases will be reimbursed an additional five cents
8 per meal; schools for which New York farm products constitute at least
9 fifteen percent of food purchases will be reimbursed an additional ten
10 cents per meal; schools for which New York farm products constitute at
11 least twenty percent of food purchases will be reimbursed an additional
12 twenty-five cents per meal.
13 The commissioner shall provide schools with an approved vendor list.
14 Schools shall verify and submit their percentage of New York farm
15 purchases to the department per the reimbursement schedule established
16 by the commissioner prior to reimbursement.
17 § 2. This act shall take effect immediately.
