        Introduced  by  Sen.  FUNKE  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Higher Education
 
        AN ACT to amend the education law, in relation to prohibiting on  campus
          residency as a requirement for scholarships, grants and awards offered
          by the state university of New York

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The education law is amended by adding a new section 141 to
     2  read as follows:
     3    § 141. Scholarships, grants and awards; campus  residency  requirement
     4  prohibited.  1.  Notwithstanding any other provision of law, no scholar-
     5  ship, grant, award or any other form of tuition  assistance  offered  by
     6  any  college  of  the  university, shall, as a condition of eligibility,
     7  require that the student receiving such  scholarship,  grant,  award  or
     8  assistance  reside on campus in campus housing, except where such schol-
     9  arship, grant,  award  or  assistance  is  specifically  designated  for
    10  on-campus housing or board.
    11    2.  Nothing in this section shall be construed to prohibit any college
    12  of the university from requiring that a student be  a  resident  of  the
    13  state  of  New  York  in  order to be eligible to receive a scholarship,
    14  grant, award or any other form of tuition assistance.
    15    § 2. This act shall take effect July 1, 2018.
