AN ACT to amend the education law, in relation to enacting "Jacobe's
law"
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. This act shall be known and may be cited as "Jacobe's law."
2 § 2. The education law is amended by adding a new section 15-a to read
3 as follows:
4 § 15-a. Reporting by school employees. 1. School employees, as defined
5 in paragraph a of subdivision three of this section, shall make a
6 reasonable and good faith effort to contact the parents or guardians of
7 the students involved in an incident of bullying or harassment after
8 verifying, in accordance with the provisions of this article, that such
9 incident has occurred.
10 2. The school employee shall contact the parent or guardian by tele-
11 phone, electronic mail, regular mail or other means.
12 3. As used in this section:
13 a. "school employee" shall mean the principal, superintendent or the
14 principal's or superintendent's designee who is charged with receiving
15 reports of harassment, bullying and discrimination in accordance with
16 paragraph a of subdivision one of section thirteen of this article.
17 b. "harassment" and "bullying" shall have the same meaning as defined
18 under subdivision seven of section eleven of this article.
19 § 3. This act shall take effect immediately.
