AN ACT to amend the education law, in relation to creating advanced
placement coursework opportunities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 305 of the education law is amended by adding two
2 new subdivisions 56 and 57 to read as follows:
3 56. (a) The commissioner shall develop a grant program to assist local
4 school districts in an effort to either establish or expand advanced
5 placement programs. Schools which currently offer fewer than four
6 advanced placement courses and have an unmet advanced placement poten-
7 tial shall be given preference for such funding. Funding for such
8 assistance shall include: recognized training that provides teachers
9 with the necessary content knowledge and instructional skills to prepare
10 students for success in advanced placement courses and on advanced
11 placement examinations, and course start-up costs such as curriculum
12 materials, necessary laboratory equipment and other materials required
13 for the offering of such courses. The commissioner shall develop addi-
14 tional grant-eligibility criteria and shall award funds to applying
15 school districts accordingly.
16 (b) The legislature shall appropriate state monies as may be necessary
17 to implement such program in accordance with the provisions of this
18 subdivision.
19 57. (a) The commissioner shall develop a mechanism to fund, for finan-
20 cially eligible students, the portion of the advanced placement exam fee
21 that is not currently funded by the federal advance placement test fee
22 program, the college board test fee waiver and the school test process-
23 ing fee waiver.

1 (b) The legislature shall appropriate state monies as may be necessary
2 to implement such mechanism in accordance with the provisions of this
3 subdivision.
4 § 2. This act shall take effect immediately.
