        Introduced  by  Sens.  KENNEDY,  BOYLE, COMRIE -- read twice and ordered
          printed, and when printed to be committed to the Committee on Investi-
          gations and Government Operations
 
        AN ACT to amend the alcoholic beverage control law, in relation to keep-
          ing drinks containing alcoholic beverages in kegs

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Paragraph (b) of subdivision 2 of section 106 of the alco-
     2  holic beverage control law, as added by chapter 512 of the laws of 2000,
     3  is amended to read as follows:
     4    (b) Notwithstanding the provisions of paragraph (a) of  this  subdivi-
     5  sion, a retail licensee for on-premises consumption may prepare and keep
     6  drinks  containing  alcoholic  beverages in dispensing machines, [having
     7  capacities of not less than a gallon, which continually mix such drinks]
     8  kegs, seltzer bottles, or other containers.  The state liquor  authority
     9  shall  promulgate  rules  and regulations regarding the size and type of
    10  containers for use under this section.
    11    § 2. This act shall take effect immediately.
