Relates to driving slow in a passing lane; any person who is not overtaking or passing a vehicle or driving five miles or more under the designated speed limit shall be subject to a fine of up to seventy-five dollars.

AN ACT to amend the vehicle and traffic law, in relation to driving
slowly in a passing lane
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 1132 to read as follows:
3 § 1132. Driving in passing lane. (a) No motor vehicle shall drive in a
4 passing lane if they are not overtaking or passing a vehicle pursuant to
5 section eleven hundred twenty-two of this article, or if they are going
6 ten miles or more under the designated speed limit, except as follows:
7 1. where required by any other section of law;
8 2. when an obstruction exists making it necessary to drive in a pass-
9 ing lane;
10 3. when approaching and passing an authorized emergency vehicle,
11 hazard vehicle, or any other vehicle which is parked, stopped or stand-
12 ing on a highway;
13 4. when directed to by a traffic-control device, police officer or
14 flag person; and
15 5. when any special hazard exists with respect to pedestrians, other
16 traffic, weather or highway conditions.
17 (b) Any person who violates this section shall be subject to a fine of
18 up to seventy-five dollars.
19 § 2. This act shall take effect immediately.
