AN ACT to amend the insurance law, in relation to requiring insurance
coverage for the influenza vaccine in certain circumstances
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subsection (i) of section 3216 of the insurance law is
2 amended by adding a new paragraph 17-a to read as follows:
3 (17-a) Every policy delivered or issued for delivery in this state
4 that provides medical, major medical, or similar comprehensive-type
5 coverage and provides coverage for immunizing agents to prevent influen-
6 za shall provide coverage for influenza vaccine and its administration
7 when such vaccine is administered in an elementary or secondary school.
8 Coverage shall be provided for immunizing agents to prevent influenza
9 that are prescribed and administered in accordance with standards and
10 requirements set forth in the education law or any other applicable law
11 or rule.
12 § 2. Subsection (l) of section 3221 of the insurance law is amended by
13 adding a new paragraph 8-a to read as follows:
14 (8-a) Every group or blanket policy delivered or issued for delivery
15 in this state that provides medical, major medical, or similar compre-
16 hensive-type coverage and provides coverage for immunizing agents to
17 prevent influenza shall provide coverage for influenza vaccine and its
18 administration when such vaccine is administered in an elementary or
19 secondary school. Coverage shall be provided for immunizing agents to
20 prevent influenza that are prescribed and administered in accordance

1 with standards and requirements set forth in the education law or any
2 other applicable law or rule.
3 § 3. Section 4303 of the insurance law is amended by adding a new
4 subsection (k-1) to read as follows:
5 (k-1) Every policy issued by a medical expense indemnity corporation,
6 a hospital service corporation or a health service corporation for
7 delivery in this state that provides medical, major medical, or similar
8 comprehensive-type coverage for immunizing agents to prevent influenza
9 shall provide coverage for influenza vaccine and its administration when
10 such vaccine is administered in an elementary or secondary school.
11 Coverage shall be provided for immunizing agents to prevent influenza
12 that are prescribed and administered in accordance with standards and
13 requirements set forth in the education law or any other applicable law
14 or rule.
15 § 4. This act shall take effect on the sixtieth day after it shall
16 have become a law.
