AN ACT to amend the vehicle and traffic law, in relation to the indemni-
fication of department of motor vehicle employees for processing non-
commercial drivers' licenses and learners' permits which do not meet
federal standards for identification
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 8 of section 502 of the vehicle and traffic law
2 is amended by adding a new paragraph (f) to read as follows:
3 (f) The commissioner and any agent or employee of the commissioner or
4 county clerk who, in good faith and without prior knowledge of any crim-
5 inal act associated with an application for a non-commercial driver's
6 license or learner's permit which does not meet federal standards for
7 identification, processes such an application shall immediately and
8 thereafter be relieved and held harmless for any and all claims,
9 damages, or liabilities including civil and criminal fines, arising from
10 any criminal act involving such non-commercial driver's license or
11 learner's permit, including but not be limited to:
12 1. identity theft offenses as defined in sections 190.78, 190.79 and
13 190.80 of the penal law;
14 2. unlawful possession of personal identification information in the
15 first degree as defined in section 190.83 of the penal law;
16 3. terrorism offenses as defined in article four hundred ninety of the
17 penal law;
18 4. forgery offenses as defined in sections 170.05, 170.10, and 170.15
19 of the penal law; or
20 5. money laundering offenses as defined in article four hundred seven-
21 ty of the penal law.
22 § 2. This act shall take effect immediately.
