        Introduced  by  Sen.  ALESI  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Crime Victims,  Crime  and
          Correction
 
        AN ACT to amend the correction law, in relation to work release programs
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

 
     1    Section 1. Subdivision 3 of section 852  of  the  correction  law,  as
     2  amended  by  chapter  691  of  the  laws  of 1977, is amended to read as
     3  follows:
     4    3. Work release programs may be established only at institutions clas-
     5  sified by the commissioner as work release facilities provided, however,
     6  such programs shall not operate in areas zoned  exclusively  residential
     7  by a municipality.  Educational release programs may be established only
     8  at  those  educational  institutions  which  shall  maintain  attendance
     9  records for participating inmates.
    10    § 2. This act shall take effect immediately, provided,  however,  that
    11  the  amendments  to  subdivision  3 of section 852 of the correction law
    12  made by section one of this act shall not affect the expiration of  such
    13  section and shall be deemed to expire therewith.
