        Introduced  by  Sen.  PARKER -- read twice and ordered printed, and when
          printed to be committed to the Committee on  Energy  and  Telecommuni-
          cations
 
        AN  ACT to amend the public service law, in relation to the discontinua-
          tion of utility service to residential customers
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 39 of the public service law is amended by adding a
     2  new subdivision 4 to read as follows:
     3    4.  Upon discontinuation of utility service to a residential customer,
     4  a gas or electric corporation shall notify such customer of their  right
     5  to  an  actual meter reading. It shall be the right of every residential
     6  customer of a gas or electric corporation, upon the  discontinuation  of
     7  utility  service,  to  obtain,  upon request, an actual meter reading by
     8  such customer's gas or electric corporation. A gas  or  electric  corpo-
     9  ration  shall  provide  such  a reading within forty-eight hours of such
    10  request, provided that if circumstances beyond the control of the gas or
    11  electric corporation make an  actual  reading  of  the  meter  extremely
    12  difficult,  such  corporation shall not be required to provide an actual
    13  meter reading. A gas or electric corporation shall not  be  required  to
    14  provide  a  physical meter reading during a holiday or non-work day, but
    15  shall instead provide such meter reading on the next workday.
    16    § 2. This act shall take effect immediately.
