          and ordered printed, and when printed to be committed to the Committee
          on  Consumer  Protection  --  recommitted to the Committee on Consumer
          Protection in accordance with Senate  Rule  6,  sec.  8  --  committee
          discharged, bill amended, ordered reprinted as amended and recommitted
          to said committee
 
        AN  ACT  to  amend  the  general business law, in relation to children's
          non-regulated camps
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  398-f  of the general business law is amended by
     2  adding four new subdivisions 4, 5, 6 and 7 to read as follows:
     3    4. (a) All children's non-regulated camps, as defined  in  subdivision
     4  one  of  this  section,  shall  register annually with the department of
     5  state.
     6    (b) No person, firm, corporation or association shall operate in  this
     7  state without registering with such department.
     8    (c) A knowing violation of this section shall be punishable by a civil
     9  penalty not to exceed five hundred dollars for each violation.
    10    5. The fee to register shall be two hundred fifty dollars, except that
    11  no  fee  shall be charged in the case of a children's non-regulated camp
    12  operated by a person, firm, corporation or association  for  charitable,
    13  philanthropic or religious purposes.
    14    6.  The  department  of  state  shall  submit  an annual report to the
    15  department of health that includes a list of all  registered  children's
    16  non-regulated  camps  within  the state; the location of each children's
    17  non-regulated camp; how many children attend a children's  non-regulated
    18  camp;  and  a  list  of  all entities that committed a violation of this
    19  section for the previous calendar year.
    20    7. Non-regulated camps shall not be  required  to  register  with  the
    21  department  under  subdivision four of this section or pay any fee under

     1  subdivision five of this section until thirty days after the  department
     2  has  promulgated regulations and created any forms and notices necessary
     3  for a camp to comply with such subdivisions.
     4    § 2. This act shall take effect immediately.
