AN ACT to amend the civil service law, in relation to the appointment
and promotion of supervisors of the emergency medical service
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 59-b of the civil service law, as added by a chap-
2 ter of the laws of 2018, amending the civil service law relating to the
3 appointment and promotion of supervisors of the emergency medical
4 service, as proposed in legislative bills numbers S. 5118-B and A.
5 6990-A, is amended to read as follows:
6 § 59-b. Promotions of supervisory personnel of the emergency medical
7 service. 1. The legislature hereby finds and declares that the contin-
8 ued, uninterrupted, adequate and efficient operation of emergency
9 medical services is necessary for the general welfare of the people;
10 that such adequate operation involves and requires personnel with highly
11 specialized ability, skill, training and knowledge, which necessitate
12 that vacancies in the emergency medical services in the positions of
13 Supervising Emergency Medical Service Specialist Level II (Captains),
14 Deputy Chief, Division Chief, and Division Commander, shall be filled as
15 far as practicable by promotion from among persons holding competitive
16 class positions in a lower grade in the department in which the vacancy
17 exists, provided that such lower grade positions are in direct line of
18 promotion, as determined by the department or municipal commission.
19 2. Promotion shall be based on merit and fitness as determined by
20 competitive examination, due weight being given to seniority. The previ-
21 ous training and experience of the candidates, and performance ratings
22 where available, may be considered and given due weight as factors in
23 determining the relative merit and fitness of candidates for promotion.
24 3. Any permanent competitive employee holding a provisional or discre-
25 tionary appointment in the affected supervisory titles of the emergency

1 medical service described in subdivision one of this section shall be
2 given the opportunity to participate in a competitive promotional exam-
3 ination for the next higher level title.
4 4. Except as provided above, the provisions of this chapter shall
5 apply to employees covered by this section.
6 § 2. This act shall take effect on the same date and in the same
7 manner as a chapter of the laws of 2018, amending the civil service law
8 relating to the appointment and promotion of supervisors of the emergen-
9 cy medical service, as proposed in legislative bills numbers S. 5118-B
10 and A. 6990-A, takes effect.
