Go to top STATE OF NEW YORK ________________________________________________________________________ 2120 2011-2012 Regular Sessions IN SENATE January 18, 2011 ___________ Introduced by Sen. KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to prohibiting parole in certain circumstances The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 70.40 of the penal law is amended by adding a new 2 subdivision 4 to read as follows: 3 4. When a person has been convicted of a class B violent felony 4 offense as defined in paragraph (a) of subdivision one of section 70.02 5 of this article and has previously been convicted of a class B violent 6 felony offense, such person shall not be eligible for parole. 7 § 2. This act shall take effect on the first of November next 8 succeeding the date on which it shall have become a law.
