AN ACT relating to publishing data on the effects of bail reform
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Legislative intent. The timing of the recent surge in
2 shootings and violent crime corresponds with the implementation of
3 changes to the bail laws passed by the majorities in the legislature and
4 signed by the governor as part of the 2019-2020 State Budget. Since the
5 start of 2020, shootings, murders, assaults and other violent crimes
6 have dramatically increased all across the state. Shootings in New York
7 City increased nearly one hundred percent from 2019 to 2020 and this
8 year shootings are up another fifty percent through July. Shootings in
9 the metropolitan areas across the state outside of New York City were up
10 seventy-five percent from 2019 to 2020 and another forty-one percent
11 this year through July.
12 It is imperative that the state fully understands the ramifications of
13 the changes to the bail reform act. The data collected by this legis-
14 lation will help with that endeavor.
15 § 2. The Office of Court Administration in collaboration with the New
16 York State Division of Criminal Justice Services shall collect data on
17 the following information:
18 (a) The number of individuals that were charged with crimes that no
19 longer qualify for bail, and a breakdown of those charges;
20 (b) The number of individuals released pending trial because the
21 offense no longer qualifies for bail and then re-offended while awaiting
22 trial; and
23 (c) The types of crimes committed by re-offenders awaiting trial.
24 The data shall be published on the Office of Court Administration's
25 website and the New York State Division of Criminal Justice Services'
26 website in a searchable format.

1 § 3. This act shall take effect immediately, provided, however, the
2 data, required to be collected and published pursuant to section two of
3 this act, shall be published within thirty days of the effective date of
4 this act.
