        AN ACT to amend the education law, in  relation  to  tuition  assistance
          program awards
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Clause (A) of subparagraph (i) of paragraph a  of  subdivi-
     2  sion  3  of section 667 of the education law, as amended by section 1 of
     3  part B of chapter 60 of the laws of 2000, is amended to read as follows:
     4    (A) (1) In the case of students who have not been granted an exclusion
     5  of parental income, have been granted an exclusion  of  parental  income
     6  pursuant  to subdivision four of section six hundred sixty-three of this
     7  part, or had a dependent for income tax purposes  during  the  tax  year
     8  next preceding the academic year for which application is made:
     9    (a)  For  students  first receiving aid after nineteen hundred ninety-
    10  three--nineteen hundred ninety-four and before two  thousand--two  thou-

    11  sand one, four thousand one hundred twenty-five dollars; or
    12    (b) For students first receiving aid in nineteen hundred ninety-three-
    13  -nineteen  hundred  ninety-four  or earlier, three thousand five hundred
    14  seventy-five dollars; or
    15    (c) For students first receiving aid in [the] two thousand--two  thou-
    16  sand one and thereafter, five thousand dollars.
    17    (2)  In the case of students receiving awards pursuant to subparagraph
    18  (iii) of this paragraph.
    19    (a) For students first receiving aid  in  nineteen hundred ninety-four
    20  --nineteen  hundred  ninety-five and nineteen hundred ninety-five--nine-
    21  teen hundred  ninety-six  and  thereafter,  three  thousand  twenty-five
    22  dollars, or
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1    (b)  For students first receiving aid in nineteen hundred ninety-two--
     2  nineteen hundred ninety-three and nineteen  hundred  ninety-three--nine-
     3  teen   hundred  ninety-four,  two  thousand  five  hundred  seventy-five
     4  dollars, or
     5    (c)  For students first receiving aid in nineteen hundred ninety-one--
     6  nineteen hundred ninety-two or earlier, two thousand four hundred  fifty
     7  dollars; or
     8    § 2. Subparagraph (iii) of paragraph a of subdivision 3 of section 667
     9  of the education law, as amended by section 1 of part B of chapter 60 of
    10  the laws of 2000, is amended to read as follows:
    11    (iii)  For students who have been granted exclusion of parental income

    12  pursuant to subdivision three of section six hundred sixty-three of this
    13  part and were single with no dependent for income  tax  purposes  during
    14  the  tax  year next preceding the academic year for which application is
    15  made, the base amount, as determined in subparagraph (i) of  this  para-
    16  graph, shall be reduced in relation to income as follows:
 
    17  Amount of income                    Schedule of reduction
    18                                      of base amount
 
    19  (A) Less than three thousand        None
    20      dollars
    21  (B) Three thousand dollars or       Thirty-one per centum of
    22      more, but not more than ten     amount in excess of three
    23      thousand dollars                thousand dollars
    24    § 3. Subparagraph (iii) of paragraph b of subdivision 3 of section 667
    25  of  the education law, as amended by chapter 309 of the laws of 1996, is

    26  amended to read as follows:
    27    (iii) For students who have been granted exclusion of parental  income
    28  pursuant to subdivision three of section six hundred sixty-three of this
    29  part  and  were  single with no dependent for income tax purposes during
    30  the tax year next preceding the academic year for which  application  is
    31  made,  the  base amount, as determined in subparagraph (i) of this para-
    32  graph, shall be reduced in relation to income as follows:
 
    33  Amount of income                    Schedule of reduction
    34                                      of base amount
 
    35  (A) Less than three thousand        None
    36      dollars
    37  (B) Three thousand dollars or       Thirty-one per centum of

    40    § 4. Subparagraph (iii) of paragraph c of subdivision 3 of section 667
    41  of the education law, as added by chapter 83 of the  laws  of  1995,  is
    42  amended to read as follows:

    44  pursuant to subdivision three of section six hundred sixty-three of this
    45  part and were single with no dependent for income  tax  purposes  during
    46  the  tax  year next preceding the academic year for which application is
    47  made, the base amount, as determined in subparagraph (i) of  this  para-
    48  graph, shall be reduced in relation to income as follows:

    51  (A) Less than one thousand          None
