        Introduced  by Sen. KAVANAGH -- read twice and ordered printed, and when
          printed to be committed to the Committee on Cities
 
        AN ACT to amend the general city law, in relation  to  electronic  entry
          cards which register personal identifying information
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The general city law is amended by  adding  a  new  section
     2  18-e to read as follows:
     3    § 18-e. Electronic entry cards or devices. An electronic entry card or
     4  device  which contains, registers or records personal identifying infor-
     5  mation shall not be required as a mechanism for a resident or resident's
     6  guest to enter or exit a residential building or apartment  unless  such
     7  resident  affirmatively  consents  in  writing  to  use  of such card or
     8  device. Such consent shall not be a term or condition  of  a  lease  and
     9  shall not be valid unless such resident is notified in writing that such
    10  consent  is entirely optional and is not required for occupancy. A resi-
    11  dent's withholding of such consent shall not have any effect  whatsoever
    12  on  the  terms  and  conditions  of  the  resident's  occupancy. For the
    13  purposes  of  this  section,  personal  identifying  information   shall
    14  include,  but  not  be  limited to, a photograph, name, address, unit or
    15  apartment number, and time of entrance or exit, and a residential build-
    16  ing shall mean an apartment house.
    17    § 2. This act shall take effect on the ninetieth day  after  it  shall
    18  have become a law.
