AN ACT to amend the transportation law, in relation to enacting the
"taxi driver protection act" requiring the posting of signs in for-
hire vehicles to prevent assault
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. This act shall be known and may be cited as the "taxi driv-
2 er protection act".
3 § 2. Section 140 of the transportation law is amended by adding a new
4 subdivision 11 to read as follows:
5 11. a. Every owner of a for-hire vehicle shall post in at least one
6 conspicuous place in the rear passenger compartment of such vehicle
7 stating in not less than sixteen point font form the following: "ATTEN-
8 TION: Assaulting A Driver Is Punishable By Up To Twenty-Five Years In
9 Prison"; provided, however, that a black car operator shall have the
10 right but not the obligation to post such a sign while providing for-
11 hire vehicle services.
12 b. For the purposes of this subdivision, the terms "for-hire vehicle"
13 and "black car operator" shall have the same meanings as provided in
14 subdivision two of section 60.07 of the penal law.
15 § 3. The commissioner shall promulgate any rules and regulations
16 necessary for the provisions of this act and shall determine the penalty
17 for failing to post such signs.
18 § 4. This act shall take effect on the one hundred eightieth day after
19 it shall have become a law.
