        Introduced  by Sen. McDONALD -- read twice and ordered printed, and when
          printed to be committed to the Committee on Veterans, Homeland Securi-
          ty and Military Affairs
 
        AN ACT to amend the private housing finance law, in relation to  prefer-
          ences  under  the  affordable  home  ownership development program for
          service related disabled veterans
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph  (a)  of  subdivision  3 of section 1112 of the
     2  private housing finance law, as amended by chapter 898 of  the  laws  of
     3  1986, is amended to read as follows:
     4    (a) Serve the lowest income households in the applicable region and is
     5  designed  to continue to be affordable to such households for a substan-
     6  tial period of time[.] or serve households in which the home buyer is  a
     7  service related disabled veteran.
     8    For purposes of this section, "service related disabled veteran" shall
     9  mean  a  person  (i)  who  served  in the active military, naval, or air
    10  service during a time of war as defined in this paragraph, or who was  a

    11  recipient  of  the  armed forces expeditionary medal, navy expeditionary
    12  medal, marine corps expeditionary medal,  or  global  war  on  terrorism
    13  expeditionary  medal, and who was discharged or released therefrom under
    14  honorable conditions, (ii) has been awarded a disability rating of forty
    15  percent or higher from the federal veteran's administration or from  the
    16  United  States department of defense, where that disability was incurred
    17  in line of duty in the active military, naval or air service,  as  docu-
    18  mented according to rules and regulations to be promulgated by the divi-
    19  sion.
    20    For  the  purposes of this section, "service during time of war" shall
    21  mean: (i) The individual in question was a recipient of the armed forces

    22  expeditionary medal, the navy expeditionary medal or  the  marine  corps
    23  expeditionary medal for participation in operations in Lebanon from June

     1  first, nineteen hundred eighty-three to December first, nineteen hundred
     2  eighty-seven,  in  Grenada  from  October twenty-third, nineteen hundred
     3  eighty-three to November twenty-first, nineteen hundred eighty-three, or
     4  in Panama from December twentieth, nineteen hundred eighty-nine to Janu-
     5  ary thirty-first, nineteen hundred ninety, or;

     6    (ii)  The  individual served on active duty for ninety days or more in
     7  the armed forces of the United States during any one  of  the  following
     8  wars or hostilities:
     9    (1) in the Mexican border campaign from the ninth day of May, nineteen
    10  hundred  sixteen, to the fifth day of April, nineteen hundred seventeen,
    11  inclusive;
    12    (2) in World War I from the  sixth  day  of  April,  nineteen  hundred
    13  seventeen  to  the  eleventh day of November, nineteen hundred eighteen,
    14  inclusive;
    15    (3) in World War II from the seventh day of December, nineteen hundred
    16  forty-one to the thirty-first day of December, nineteen  hundred  forty-
    17  six, inclusive;

    18    (4)  in  the  Korean  hostilities from the twenty-seventh day of June,
    19  nineteen hundred fifty to the  thirty-first  day  of  January,  nineteen
    20  hundred fifty-five, inclusive;
    21    (5)  in  the  Vietnam conflict from the twenty-second day of December,
    22  nineteen hundred sixty-one to the seventh day of May,  nineteen  hundred
    23  seventy-five;
    24    (6)  in the Persian Gulf conflict from the second day of August, nine-
    25  teen hundred ninety to the end of such conflict.
    26    § 2. This act shall take effect on the thirtieth day  after  it  shall
    27  have become a law.
