        Introduced  by  Sen. VALESKY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Higher Education
 
        AN ACT to amend the education law, in relation to establishing the  "say
          yes to education demonstration program"
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. The education law is amended by adding a new section  669-e
     2  to read as follows:
     3    §  669-e. Say yes to education demonstration program. 1.  The "say yes
     4  to education demonstration program" is hereby established  in  the  city
     5  school  district  of the city of Syracuse and in up to five other cities
     6  with populations of less than one  million,  and  family  poverty  rates
     7  calculated  in  the two thousand federal census equal to or greater than
     8  thirteen percent.
     9    2. Students who are enrolled in participating  districts  pursuant  to
    10  subdivision one of this section and are enrolled in twelfth grade during
    11  the  two  thousand  nine--two  thousand  ten school year, and subsequent

    12  years thereafter and: (a) who  had  previously  been  enrolled  in  such
    13  districts  during  their  tenth and eleventh grade years; (b) who have a
    14  high school diploma or its equivalent; (c) who are matriculated  at  the
    15  state  university  of New York (SUNY) or the city university of New York
    16  (CUNY); and who apply for Federal Pell Grants and  the  New  York  state
    17  tuition  assistance  program pursuant to section six hundred sixty-seven
    18  of this subpart, and other available federal  and  state  aid  shall  be
    19  eligible for awards pursuant to subdivision three of this section.
    20    3.  Eligible students shall receive awards in an amount up to the cost
    21  of tuition and fees at SUNY and CUNY schools less other state or federal

    22  awards received by such students, or the  actual  cost  of  tuition  and
    23  fees, whichever is less.
    24    4.  The  president  of the higher education services corporation shall
    25  promulgate any necessary rules and regulations for the implementation of

     1  this section on or before  December  thirty-first,  two  thousand  nine,
     2  provided,  however,  that current duration, income eligibility and grade
     3  point average standards applied to applicants for the tuition assistance

     4  program  shall  be  applied  to applicants for the "say yes to education
     5  demonstration program."
     6    5. This program shall be  funded  pursuant  to  appropriation  by  the
     7  legislature.
     8    § 2. This act shall take effect immediately.
