        Introduced  by  Sen.  RANZENHOFER -- read twice and ordered printed, and
          when printed to be committed to the Committee on Education
 
        AN ACT to amend the education law, in relation to education  cooperative
          contracts
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 

     1    Section 1. Section 1709 of the education law is amended  by  adding  a
     2  new subdivision 43 to read as follows:
     3    43.  Notwithstanding the provisions of subdivision fourteen of section
     4  three hundred five of this chapter, section one  hundred  three  of  the
     5  general  municipal  law,  or any other provision of law to the contrary,
     6  the board of education shall be authorized to enter into a  "cooperative
     7  contract" with another school district, a county, municipality, board of
     8  educational  services, the state or any division or agency of the state,
     9  for any service, good or product it has the duty or  power  to  provide,
    10  provided  that the board finds that the contract cost is appropriate and
    11  entry into a "cooperative contract" will result in a cost savings to the

    12  school district.  For  purposes  of  this  subdivision,  a  "cooperative
    13  contract"  means  a contract for a service, good or product that another
    14  school district, county, municipality, board  of  educational  services,
    15  state or division or agency of the state is already providing through an
    16  existing contract.
    17    § 2. This act shall take effect immediately.
