No. 334 2015-2016 Regular Sessions IN SENATE January 29, 2015 ___________ Introduced by Sens. ADDABBO, AVELLA, COMRIE, PERKINS -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the civil service law, in relation to enacting the "state workforce injury reduction act" The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. This act shall be known and may be cited as the "state 2 workforce injury reduction act". 3 § 2. Section 7 of the civil service law is amended by adding a new 4 subdivision 7 to read as follows: 5 7. Each state agency referenced in the annual report issued by the 6 president pursuant to subdivision six of this section shall within nine- 7 ty days after receipt of such report submit to the president a written 8 action plan for reducing occurrences of such injuries in the coming 9 year. Upon receipt of such action plan but no later than one hundred 10 twenty days after issuing the report pursuant to subdivision six of this 11 section, the president shall issue an addendum to the report with a 12 summary of all of the action plans submitted by each affected state 13 agency to the governor, the temporary president of the senate and the 14 speaker of the assembly. In any case where one or multiple collective 15 bargaining units are present within an affected state agency, the state 16 agency shall include the collective bargaining representative in any 17 discussions on reports issued pursuant to this subdivision. Nothing in 18 this subdivision shall be construed to conflict with a state agency's 19 responsibility to bargain with the collective bargaining representative 20 pursuant to article fourteen of this chapter. 21 § 3.
