AN ACT to amend the economic development law, in relation to establish-
ing the New York state advisory council on coronavirus economic recov-
ery and workforce development; and providing for the repeal of such
provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The economic development law is amended by adding a new
2 article 23 to read as follows:

7 recovery and workforce development.
8 § 455. New York state advisory council on coronavirus economic recov-
9 ery and workforce development. 1. There is hereby created within the
10 department the New York state advisory council on coronavirus economic
11 recovery and workforce development for advising the department as

1 provided in this section. The council shall concentrate both on corona-
2 virus economic recovery as well as issues impacting business post recov-
3 ery.
4 2. (a) The council shall consist of sixteen members: three members
5 appointed by the temporary president of the senate, three members
6 appointed by the speaker of the assembly, one member appointed by the
7 minority leader of the senate, one member appointed by the minority
8 leader of the assembly, and the eight remaining members appointed by the
9 governor, at least two of which shall be small business owners in the
10 state who employ fifty or less employees.
11 (b) The appointed council members shall represent various geographic
12 areas of the state and shall be knowledgeable in at least one of the
13 following areas:
14 (i) business;
15 (ii) education;
16 (iii) workforce development; or
17 (iv) public-private partnerships for economic recovery.
18 3. The council shall make recommendations to the commissioner on
19 certain subjects including, but not limited to:
20 (a) opportunities for collaboration between employers and educational
21 institutions;
22 (b) strategies to address any skills gaps;
23 (c) strategies to create sustainable pathways into careers; and
24 (d) strategies for workplace learning and skills application.
25 4. The council shall meet as frequently as its business may require,
26 but not less than twice a year. The presence of a majority of the
27 members shall constitute a quorum. The members of the council shall
28 receive no compensation for their services as members.
29 5. The commissioner, upon request of the council, shall designate an
30 officer or employee of the office to act as secretary of the council and
31 shall assign from time to time such other employees as the council may
32 require.
33 6. The council shall develop and submit a report to the governor, the
34 speaker of the assembly, the temporary president of the senate, the
35 chair of the senate committee on commerce, economic development, and
36 small business, the ranking minority member of the senate committee on
37 commerce, economic development and small business, the chair of the
38 assembly committee on economic development, job creation, commerce and
39 industry and the ranking minority member of the assembly committee on
40 economic development, job creation, commerce and industry no later than
41 one year from the effective date of this act and annually thereafter.
42 Such report shall include recommendations required by this section and
43 recommendations to effectively implement any initiative identified by
44 the council.
45 § 2. This act shall take effect immediately and shall expire and be
46 deemed repealed four years after it shall have become a law.
