AN ACT to amend the insurance law, in relation to coverage for the
treatment of lymphedema
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subsection (i) of section 3216 of the insurance law is
2 amended by adding a new paragraph 28 to read as follows:
3 (28) Every policy which provides coverage for lymphedema shall include
4 coverage for necessary aids or devices for such treatment including, but
5 not limited to, compression sleeves, gloves, gauntlets and other
6 garments.
7 § 2. Subsection (k) of section 3221 of the insurance law is amended by
8 adding a new paragraph 17 to read as follows:
9 (17) A group or blanket accident or health insurance policy or issuing
10 a group or blanket policy for delivery in this state which provides
11 coverage for lymphedema shall include coverage for necessary aids or
12 devices for such treatment including, but not limited to, compression
13 sleeves, gloves, gauntlets and other garments.
14 § 3. Section 4303 of the insurance law is amended by adding a new
15 subsection (hh) to read as follows:
16 (hh) A medical expense indemnity corporation, a hospital service
17 corporation or a health service corporation which provides coverage for
18 lymphedema shall include coverage for necessary aids or devices for such
19 treatment including, but not limited to, compression sleeves, gloves,
20 gauntlets and other garments.
21 § 4. This act shall take effect on the first of January next succeed-
22 ing the date on which it shall have become a law and shall apply to all
23 policies or contracts issued, renewed, modified, altered or amended on
24 and after such effective date.
