AN ACT to amend the real property tax law, in relation to the assessment
of real property used to store spent nuclear fuel
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The real property tax law is amended by adding a new
2 section 563 to read as follows:
3 § 563. Value of lands used to store spend nuclear fuel. Notwithstand-
4 ing any other provision of law, real property owned or leased on which
5 spent nuclear fuel is stored and is pending further or final disposal,
6 including fuel stored in a spent fuel pool or in a dry cask storage
7 system, from a nuclear power station following the permanent cessation
8 of power operations of such station, shall be assessed at a rate that
9 reflects the best possible use of those lands.
10 § 2. This act shall take effect January 1, 2022.
