AN ACT to amend the education law, in relation to establishing the
community college funding study
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 6304 of the education law is amended by adding a
2 new subdivision 14 to read as follows:
3 14. Community college funding study. a. (i) The state university trus-
4 tees shall require each community college president in the state univer-
5 sity system to establish an internal committee that shall be directed to
6 study the effectiveness of the current full time equivalent (FTE) fund-
7 ing formula and alternatives based on funding by academic program that
8 takes into account the specific mission, needs, geographic location and
9 uniqueness of such community college.
10 (ii) The internal committee established by each such community college
11 president shall consult with the state university board of trustees and
12 provide information that may be requested to such trustees to aid in the
13 creation of recommendations required pursuant to this subdivision, and
14 shall consult with representatives from the employee collective bargain-
15 ing organization that represents faculty, higher education professionals
16 and the regional state university of New York community college council
17 in such region, if applicable.
18 (iii) Each internal committee shall consider:
19 (A) the effect of the current FTE funding model on overall funding for
20 the community college and alternatives to such model;

1 (B) the creation of new academic programs that may be beneficial in
2 supporting regional business and industry workforce needs;
3 (C) duplication of academic degree programs in such community
4 college's region; and
5 (D) any other issues the internal committee deems necessary.
6 (iv) Each internal committee shall report recommendations to the state
7 university system's board of trustees on December first, two thousand
8 twenty, and the state university board of trustees shall report recom-
9 mendations to the chairs of the senate and assembly higher education
10 committees by January first, two thousand twenty-one provided however,
11 that nothing in this section shall be construed to require a change in
12 state support.
13 b. (i) The city university trustees shall establish an internal
14 committee that shall be directed to study the effectiveness of the
15 current full time equivalent (FTE) funding formula in use at its commu-
16 nity colleges and alternatives based on funding by academic program. The
17 internal committee shall include representatives of the community
18 colleges.
19 (ii) This internal committee shall consult with the city university
20 board of trustees and provide information that may be requested by such
21 trustees to aid in the creation of recommendations required pursuant to
22 this subdivision, and shall consult with representatives from the
23 employee collective bargaining organization that represents faculty and
24 higher education professionals.
25 (iii) The internal committee shall consider:
26 (A) the effect of the current FTE funding model on overall funding for
27 the community colleges and alternatives to such model;
28 (B) the creation of new academic programs that may be beneficial in
29 supporting local businesses and industry workforce needs;
30 (C) duplication of academic degree programs in the city; and
31 (D) any other issues the internal committee deems necessary.
32 (iv) The internal committee shall report recommendations to the city
33 university's board of trustees on December first, two thousand twenty,
34 and the city university board of trustees shall report recommendations
35 to the chairs of the senate and assembly higher education committees by
36 January first, two thousand twenty-one, provided however, that nothing
37 in this section shall be construed to require a change in state
38 support.
39 § 2. This act shall take effect immediately.
