        Introduced by Sen. MARCHIONE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN  ACT  to  amend the public health law, in relation to opioid overdose
          prevention
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subparagraphs (iii) and (iv) of paragraph (b) of subdivi-
     2  sion 3 of section 3309 of the public health law, as amended  by  chapter
     3  42  of the laws of 2014, are renumbered subparagraphs (iv) and (v) and a
     4  new subparagraph (iii) is added to read as follows:
     5    (iii) Notwithstanding any other law, rule or regulation to the contra-
     6  ry, a school nurse having undertaken  training  in  an  opioid  overdose
     7  prevention  program approved pursuant to subdivision one of this section
     8  may administer, directly or  indirectly,  an  opioid  antagonist  to  an
     9  opioid antagonist recipient.
    10    §  2.  Subparagraph  (iv) of paragraph (a) of subdivision 3 of section
    11  3309 of the public health law, as amended by chapter 42 of the  laws  of
    12  2014,  is  renumbered  subparagraph  (v)  and a new subparagraph (iv) is
    13  added to read as follows:
    14    (iv) "School nurse" means a person licensed or authorized to  practice
    15  nursing  pursuant  to  section  sixty-nine hundred five of the education
    16  law.
    17    § 3. This act shall take effect immediately.
