        Introduced by Sens. HINCHEY, JORDAN, SEPULVEDA -- read twice and ordered
          printed,  and  when printed to be committed to the Committee on Higher
          Education -- recommitted to  the  Committee  on  Higher  Education  in
          accordance  with Senate Rule 6, sec. 8 -- reported favorably from said
          committee, ordered to first and second  report,  ordered  to  a  third
          reading,  amended  and  ordered  reprinted, retaining its place in the
          order of third reading
 
        AN ACT to amend the  education  law,  in  relation  to  opioid  overdose
          prevention in college housing
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The education law is amended by adding a new section 6438-a
     2  to read as follows:
     3    § 6438-a. Opioid overdose prevention  in  college  housing.  1.  Every
     4  campus  of the state university of New York and every campus of the city
     5  university of New York shall provide training in the  administration  of
     6  opioid  antagonists pursuant to a program approved under section thirty-
     7  three hundred nine of the public health law to every resident  assistant
     8  employed by such campus. Such campuses shall provide and maintain onsite
     9  in each college-owned or college-operated housing opioid antagonists, as
    10  defined  in  section thirty-three hundred nine of the public health law,
    11  in quantities and types deemed  by  the  commissioner  of  health.  Such
    12  opioid  antagonists  shall be accessible by every resident assistant for
    13  use during emergencies to any student,  staff  or  other  individual  on
    14  college-owned  or  college-operated housing premises suspected of having
    15  an opioid overdose whether or not there is a previous history of  opioid
    16  abuse.
    17    2. Each campus of the state university of New York and every campus of
    18  the  city  university of New York may designate additional employees who
    19  volunteer to administer opioid  antagonists  in  the  event  a  resident
    20  assistant  is  not  physically present at a suspected overdose incident,

     1  provided that such employee is trained in the administration  of  opioid
     2  antagonists  by  a  program  approved under section thirty-three hundred
     3  nine of the public health law.
     4    3. Any person or entity acting reasonably and in good faith in compli-
     5  ance with this section shall not be subject to criminal, civil or admin-
     6  istrative liability solely by reason of such action.
     7    § 2. This act shall take effect immediately.
