AN ACT to amend the alcoholic beverage control law, in relation to auto-
mobile racing facilities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3 of the alcoholic beverage control law is amended
2 by adding a new subdivision 20-f to read as follows:
3 20-f. "Automobile racing facility" means any closed-course motorsports
4 complex and its ancillary grounds that has at least fifty thousand fixed
5 seats for race patrons and hosts at least one NASCAR Sprint Cup series
6 race and at least two other nationally recognized racing events each
7 calendar year.
8 § 2. The opening paragraph of subdivision 5 of section 106 of the
9 alcoholic beverage control law, as amended by chapter 83 of the laws of
10 1995, is amended to read as follows:
11 No alcoholic beverages shall be sold, offered for sale or given away
12 upon any premises licensed to sell alcoholic beverages at retail for
13 on-premises consumption, except automobile racing facilities, during the
14 following hours:
15 § 3. Section 106 of the alcoholic beverage control law is amended by
16 adding a new subdivision 5-a to read as follows:
17 5-a. No alcoholic beverages shall be sold, offered for sale or given
18 away upon an automobile racing facility licensed to sell alcoholic
19 beverages at retail for on-premises consumption between four ante meri-
20 diem and eight ante meridiem.
21 § 4. This act shall take effect immediately.
