        AN ACT to amend the public service law, in relation to enacting the "New
          York Renewable Portfolio Standard Act of 2019"

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. This act shall be known and may be cited as the  "New  York
     2  Renewable Portfolio Standard Act of 2019".
     3    § 2. Legislative intent and findings. The renewable portfolio standard
     4  (RPS)  has  been  New  York's  primary  policy initiative to promote the
     5  development of new renewable energy resources since it  was  established
     6  in  2004. The 2002 state energy plan warned of the possible consequences
     7  of New York's fossil fuel dependency, noting that  the  state's  primary
     8  sources  of  energy have significant long-term environmental effects and
     9  ultimately face depletion. In establishing the renewable portfolio stan-
    10  dard, the public service commission  recognized  these  concerns,  among
    11  others,  and  stated they were concerned with the effects on our climate
    12  of fossil-fired generation and the security  implications  of  importing
    13  from out of state much of the fuel needed to supply New York's electric-
    14  ity needs.
    15    §  3.  Section  5 of the public service law is amended by adding a new
    16  subdivision 7 to read as follows:
    17    7. a. For the purpose of this subdivision the term "renewable  portfo-
    18  lio  standard"  means  the  renewable  energy  policy established by the
    19  department.
    20    b. The renewable portfolio standard for the state shall include a goal
    21  for renewable resources of 37.5 percent by the year two  thousand  twen-
    22  ty-five of New York's projected total electrical energy load.

     1    c. The renewable portfolio standard for the state shall include a goal
     2  for  renewable resources of fifty percent by the year two thousand thir-
     3  ty-five of New York's projected total electrical energy load.
     4    d. The renewable portfolio standard for the state shall include a goal
     5  for  renewable  resources  of  eighty  percent  by the year two thousand
     6  fifty-five of New York's projected total electrical energy load.
     7    e. The public service commission shall  pursue  policies  and  targets
     8  consistent with the renewable portfolio standard goals set forth in this
     9  chapter.
    10    § 4. This act shall take effect immediately.
