AN ACT to amend the agriculture and markets law, in relation to the
manufacturing and sale of imitation birch and walnut syrups and the
branding and labeling of such syrups
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 203 of the agriculture and markets law is amended
2 to read as follows:
3 § 203. Manufacture and sale of imitation maple, birch or walnut sugar
4 and syrup prohibited. (a) 1. No person shall manufacture for sale, keep
5 for sale, or offer or expose for sale, any sugar in imitation or
6 semblance of maple sugar which is not pure maple sugar, nor any syrup in
7 imitation or semblance of maple syrup, which is not pure maple syrup,
8 nor shall any person manufacture, offer or expose for sale any sugar as
9 and for maple sugar which is not pure maple sugar, nor any syrup as and
10 for maple syrup which is not pure maple syrup.
11 2. For the purpose of this article the term "maple sugar" shall be
12 deemed to mean sugar made from pure maple sap or pure maple syrup, and
13 the term "maple syrup" shall be deemed to mean syrup made from pure
14 maple sap.
15 (b) 1. No person shall manufacture for sale, keep for sale, or offer
16 or expose for sale, any sugar in imitation or semblance of birch sugar
17 which is not pure birch sugar, nor any syrup in imitation or semblance
18 of birch syrup, which is not birch syrup, nor shall any person manufac-
19 ture, offer or expose for sale any sugar as and for birch sugar which is
20 not pure birch sugar, nor any syrup as and for birch syrup which is not
21 pure birch syrup.
22 2. For the purpose of this article the term "birch sugar" shall be
23 deemed to mean sugar made from pure birch sap or pure birch syrup, and

1 the term "birch syrup" shall be deemed to mean syrup made from pure
2 birch sap.
3 (c) 1. No person shall manufacture for sale, keep for sale, or offer
4 or expose for sale, any sugar in imitation or semblance of walnut sugar
5 which is not pure walnut sugar, nor any syrup in imitation or semblance
6 of walnut syrup, which is not pure walnut syrup, nor shall any person
7 manufacture, offer or expose for sale any sugar as and for walnut sugar
8 which is not pure walnut sugar, nor any syrup as and for walnut syrup
9 which is not walnut syrup.
10 2. For the purpose of this article the term "walnut sugar" shall be
11 deemed to mean sugar made from pure walnut sap or pure walnut syrup, and
12 the term "walnut syrup" shall be deemed to mean syrup made from pure
13 walnut sap.
14 § 2. Section 204 of the agriculture and markets law is amended to read
15 as follows:
16 § 204. Branding and labeling of maple, birch or walnut sugar and syrup
17 mixtures. No person shall manufacture, sell or expose for sale, any
18 compound or mixture as and for sugar which shall be made up of maple,
19 birch or walnut sugar mixed with any other sugar or any other substance
20 without branding or labeling the said sugar with a statement giving the
21 ingredients of which it is made up. No person shall manufacture, sell,
22 expose for sale or offer for sale any compound or mixture as syrup which
23 shall be made up of maple, birch or walnut syrup mixed with any other
24 syrup or ingredient without branding or labeling said syrup with a
25 statement giving the ingredients of which it is made up. This shall not
26 be construed to apply to a syrup or syrups manufactured and sold for
27 medicinal purposes only.
28 § 3. This act shall take effect on the thirtieth day after it shall
29 have become a law.
