AN ACT to amend the vehicle and traffic law, in relation to carbon
monoxide poisoning
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph (a) of paragraph 1 of subdivision (c) of
2 section 301 of the vehicle and traffic law, as amended by chapter 444
3 of the laws of 2016, is amended to read as follows:
4 (a) A safety inspection shall be made with respect to the brakes;
5 steering mechanism; wheel alignment; lights, including but not limited
6 to the lights which are designed and placed on a vehicle for the purpose
7 of illuminating the vehicle's license plates; odometer; tire pressure;
8 seat safety belts; shoulder harness safety belts; any window which is
9 composed of, covered by or treated with any material which has a light
10 transmittance of less than seventy percent pursuant to section three
11 hundred seventy-five of this title; exhaust system for the purposes of
12 ensuring that carbon monoxide levels in the cab of the vehicle have not
13 reached unsafe levels in excess of seventy parts per million and such
14 other mechanisms and equipment as shall be determined by the commission-
15 er to be necessary for proper and safe operations. Such inspection shall
16 also be made with respect to vehicle identification number. Upon
17 inspection, the mileage appearing on the odometer shall be recorded upon
18 the inspection sticker.
19 § 2. The vehicle and traffic law is amended by adding a new section
20 397-c to read as follows:
21 § 397-c. Education against dangers of carbon monoxide poisoning. The
22 commissioner, in consultation with the chair of the consumer protection
23 board, shall prepare and distribute with each operator's license, wheth-
24 er issued or renewed, a pamphlet on the warning signs of carbon monoxide

1 poisoning and the appropriate actions to be taken to prevent such acci-
2 dental poisoning.
3 § 3. This act shall take effect on the one hundred eightieth day after
4 it shall have become a law. Effective immediately, the addition, amend-
5 ment and/or repeal of any rule or regulation necessary for the implemen-
6 tation of this act on its effective date are authorized to be made and
7 completed on or before such effective date.
