AN ACT to amend the public health law, in relation to office-based
surgery
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (i) of subdivision 1 of section 230-d of the
2 public health law, as added by chapter 365 of the laws of 2007, is
3 amended to read as follows:
4 (i) "Licensee" shall mean an individual licensed or otherwise author-
5 ized under articles one hundred thirty-one or one hundred thirty-one-B
6 of the education law except it shall not include an individual licensed
7 under both articles one hundred thirty-one and one hundred thirty-three
8 of the education law who is practicing dentistry in a professional
9 service corporation or in any other entity authorized only to engage in
10 the practice of dentistry.
11 § 2. This act shall take effect immediately.
