        Introduced  by  Sens. KENNEDY, GRIFFO -- read twice and ordered printed,
          and when printed to be committed to the Committee on Labor --  commit-

        AN ACT in relation to conducting a study on the use of solid  antimicro-
          bial materials for touch surfaces in the construction of public build-
          ings
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. For the purposes of this act,  the  following  terms  shall
     2  have the following meanings:
     3    (a)  "Solid  antimicrobial materials" means solid products or surfaces
     4  that kill or slow  the  spread  of  microorganisms  including  bacteria,
     5  viruses, protozoans and fungi.
     6    (b)  "Touch  surface"  means  any surface or fixture within a building
     7  that a person frequently comes into  contact  with,  including  but  not
     8  limited  to:   door handles, bathroom fixtures, bed rails, handrails and
     9  light switches.
    10    § 2. The commissioner of health, in consultation with the commissioner
    11  of the office of general services, shall conduct a study on the  use  of
    12  solid  antimicrobial materials for touch surfaces in the construction of
    13  public buildings in this state.
    14    § 3. The study shall include, but shall not be limited to, the follow-
    15  ing information:
    16    (a) identification of different types of solid  antimicrobial  materi-
    17  als,  including but not limited to silver and copper, and the effective-
    18  ness of each such  material  in  reducing  the  spread  of  disease  and
    19  infection;
    20    (b)  the  potential  costs,  including the potential cost benefits, if
    21  any, associated with the use of solid antimicrobial materials for  touch
    22  surfaces;
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1    (c)  the  feasibility of using solid antimicrobial materials for touch
     2  surfaces, including an analysis of the market availability of such mate-
     3  rials;
     4    (d)  identification  of frequently touched surfaces that could present
     5  an infection risk; and
     6    (e) recommendations for the type or types of solid antimicrobial mate-
     7  rials to be used for touch surfaces in the construction of public build-
     8  ings in this state.
     9    § 4. The commissioner of health shall submit such study to the  gover-
    10  nor,  the  temporary  president  of  the  senate, and the speaker of the
    11  assembly within one year after the effective date of this act.
    12    § 5. This act shall take effect immediately.
