AN ACT to amend the vehicle and traffic law, in relation to the issuance
of specialty plates for members of AMVETS
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 404-dd to read as follows:
3 § 404-dd. Distinctive plates for members of AMVETS. 1. Any member of
4 AMVETS residing in this state shall, upon request, be issued a license
5 plate bearing the word "AMVETS". Application for said license plate
6 shall be filed with the commissioner in such form and detail as the
7 commissioner shall prescribe.
8 2. The distinctive plate authorized herein shall be issued upon proof,
9 satisfactory to the commissioner, that the applicant is a member of
10 AMVETS.
11 3. A distinctive plate issued pursuant to this section shall be issued
12 in the same manner as other number plates upon payment of the regular
13 registration fee prescribed by section four hundred one of this article,
14 provided, however, that an additional one-time service charge of ten
15 dollars shall be charged for such plate.
16 4. For the purposes of this section, "AMVETS" shall mean the veterans
17 service organization chartered by congress as a membership corporation
18 created pursuant to chapter 227 of title 36 of the United States code.
19 § 2. Subdivision 1-a of section 404 of the vehicle and traffic law, as
20 amended by chapter 103 of the laws of 2016, is amended to read as
21 follows:
22 1-a. The commissioner may issue special number plates to applicants
23 who are members of veterans organizations in the same manner as other

1 number plates are issued pursuant to this article. Such special number
2 plates shall be issued only upon (a) payment of a one-time service
3 charge of ten dollars in addition to the regular registration fee
4 prescribed by section four hundred one of this article, and (b)
5 submission of proof, satisfactory to the commissioner, that the appli-
6 cant is presently a member of the veterans organization for which such
7 plate is requested. Such membership shall be verified annually by the
8 applicant. Application for such plates shall be made in accordance with
9 regulations promulgated by the commissioner with respect to the issuance
10 of such plates. Provided, however, that nothing contained herein shall
11 be deemed to supersede the provisions of section four hundred four-d,
12 four hundred four-e, four hundred four-h, four hundred four-i, four
13 hundred four-j, four hundred four-k, four hundred four-p [or], four
14 hundred four-aa, or four hundred four-dd of this article.
15 § 3. 1. A distinctive plate established pursuant to section 404-dd of
16 the vehicle and traffic law as added by section one of this act shall
17 only be designed, produced and issued upon the delivery to the depart-
18 ment of motor vehicles of a surety bond in the amount of six thousand
19 dollars, which shall be executed by a surety company authorized by the
20 department of financial services to transact business in this state.
21 Provided, however, that if the commissioner of motor vehicles shall have
22 received prior to plate design, production and issuance at least two
23 hundred orders for such distinctive plate together with the additional
24 one-time service charge applicable to each such order, which shall be
25 non-refundable, no such surety bond shall be required. All service
26 charges collected pursuant to this section shall be deposited pursuant
27 to the provisions of section 404-oo of the vehicle and traffic law to
28 the credit of the department of motor vehicles distinctive plate devel-
29 opment fund established by section 95-g of the state finance law and
30 shall be used for the design, production, advertising and distribution
31 of distinctive license plates in accordance with such section 95-g.
32 2. If, upon the expiration of two years following the date upon which
33 distinctive plates in the series are first available for sale two
34 hundred or more sets of such plates are sold, a bond delivered pursuant
35 to this section shall be discontinued. If fewer than two hundred sets of
36 such plates are sold by such time, the department of motor vehicles
37 shall be entitled to recover against the bond in an amount proportionate
38 to such shortfall.
39 § 4. This act shall take effect on the one hundred eightieth day after
40 it shall have become a law; provided, however, that section three of
41 this act shall take effect immediately; provided further, however, that
42 effective immediately, the addition, amendment and/or repeal of any rule
43 or regulation necessary for the implementation of this act on its effec-
44 tive date is authorized and directed to be made and completed on or
45 before such effective date.
