        Introduced  by  Sen.  YOUNG  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Higher Education -- recom-
          mitted to the Committee on Higher Education in accordance with  Senate
          Rule  6,  sec.  8  --  committee  discharged,  bill  amended,  ordered
          reprinted as amended and recommitted to said committee

        AN ACT to amend the education law, in relation to authorizing the  board
          of  trustees of the state university of New York to offer certain non-
          resident undergraduate students separate tuition rates for  attendance
          at  selected state-operated institutions; and providing for the repeal
          of such provisions upon the expiration thereof
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph h of subdivision 2 of section 355 of the educa-
     2  tion law is amended by adding a new subparagraph 4-a to read as follows:
     3    (4-a) Commencing with the two thousand nineteen--two  thousand  twenty
     4  academic  year and ending in the two thousand twenty-three--two thousand
     5  twenty-four academic year, the board of trustees of the state university
     6  is authorized to designate selected state-operated institutions  of  the
     7  state  university  for participation in a program allowing eligible non-
     8  resident undergraduate students that reside within two hundred miles  of
     9  a  selected  institution to pay separate tuition rates for attendance at
    10  those selected institutions. In selecting institutions for this program,
    11  such board of trustees shall consider out-of-state competition,  current
    12  or  projected  levels  of  high school graduates within an institution's
    13  recruitment region, and enrollment capacity  and  physical  location  of
    14  these  institutions.  The  board  of trustees of the state university is
    15  further authorized to set such separate tuition rates, which  shall  not
    16  be  set  below  an  amount  equal to one and one-half times the in-state
    17  tuition rate at the designated institution. Such separate tuition  rates
    18  may  be  offered  only  to  eligible non-resident students, the total of
    19  which shall not exceed ten percent  of  enrollment  at  each  designated

     1  institution.    Each  state-operated  institution  that  is selected for
     2  participation in this program shall report  annually  to  the  board  of
     3  trustees of the state university on the impact of this program.
     4    §  2.  This  act shall take effect immediately and shall expire and be
     5  deemed repealed June 1, 2024.
