        Introduced by Sens. GALLIVAN, KENNEDY -- read twice and ordered printed,
          and when printed to be committed to the Committee on Commerce, Econom-
          ic  Development  and Small Business -- recommitted to the Committee on
          Commerce, Economic Development and Small Business in  accordance  with
          Senate  Rule  6, sec. 8 -- committee discharged, bill amended, ordered

        AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
          providing an exemption for a retail liquor license
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1.  Paragraph (e-5) of subdivision 7  of  section  64  of  the
     2  alcoholic  beverage  control law, as added by chapter 192 of the laws of
     3  2013 is redesignated paragraph (e-6) and a new paragraph (e-7) is  added
     4  to read as follows:
     5    (e-7) Notwithstanding the provisions of paragraph (a) of this subdivi-
     6  sion,  the authority may issue a retail license for on-premises consump-
     7  tion for a premises which shall be located within two hundred feet of  a

     8  building  occupied  exclusively as a church, synagogue or other place of
     9  worship, provided such premises constitute a premises for  the  sale  of
    10  food  or  beverages  at  retail  for consumption on the premises located
    11  wholly within  the  boundaries  of  the  county  of  Erie,  bounded  and
    12  described as follows:
    13  BEGINNING  at  a  point on the easterly side of Abbott Road, distant two
    14  hundred five and fifty nine hundredths feet northerly  from  the  corner
    15  formed  by the intersection of the easterly side of Abbott Road with the
    16  northerly side of Shenandoah Road; running  thence  northerly,  parallel
    17  with  Abbott Road, eighty-five feet to the intersection of easterly side
    18  of Abbott Road with the southerly side of Naragansett Road; thence east-

    19  erly, parallel with Naragansett Road, one  hundred  forty  feet;  thence
    20  southerly, parallel with Abbott Road, eighty-five feet; thence westerly,
    21  parallel with Naragansett Road, one hundred forty feet.
    22    § 2. This act shall take effect immediately.
