        Introduced  by  Sen. KENNEDY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Insurance
 
        AN ACT to amend the insurance law, in relation to coverage  for  opioid-
          addiction treatment medications
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. Subsection (i) of section 3216  of  the  insurance  law  is
     2  amended by adding a new paragraph 30 to read as follows:
     3    (30)  Every policy delivered or issued for delivery in this state that
     4  provides medical, major medical, or similar comprehensive-type  coverage
     5  and  provides coverage for prescription drugs shall provide coverage for
     6  opioid-addiction treatment medications. Such coverage may be subject  to
     7  co-pays, coinsurance, or deductibles, provided that the co-pays, coinsu-
     8  rance,  or  deductibles  are  at least as favorable to an insured as the
     9  co-pays, coinsurance, or deductibles that apply to  coverage  for  other
    10  prescription drugs.
    11    § 2. Subsection (k) of section 3221 of the insurance law is amended by

    12  adding a new paragraph 19 to read as follows:
    13    (19)  Every policy delivered or issued for delivery in this state that
    14  provides medical, major medical, or similar comprehensive-type  coverage
    15  and  provides coverage for prescription drugs shall provide coverage for
    16  opioid-addiction treatment medications. Such coverage may be subject  to
    17  co-pays, coinsurance, or deductibles, provided that the co-pays, coinsu-
    18  rance,  or  deductibles  are  at least as favorable to an insured as the
    19  co-pays, coinsurance, or deductibles that apply to  coverage  for  other
    20  prescription drugs.
    21    §  3.  Section  4303  of  the insurance law is amended by adding a new
    22  subsection (jj) to read as follows:
    23    (jj) Every policy delivered or issued for delivery in this state  that

    24  provides  medical, major medical, or similar comprehensive-type coverage
    25  and provides coverage for prescription drugs shall provide coverage  for

     5  prescription drugs.

     6    § 4. This act shall take effect immediately and  shall  apply  to  any
     7  policy issued, delivered, modified, amended, or renewed on or after such
     8  effective date.
