AN ACT to amend the education law, in relation to directing the commis-
sioner of education to establish standards for the maintenance and
repair of school buildings and exempting expenditures for the mainte-
nance and repair of school buildings from the tax levy limit
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 305 of the education law is amended by adding a new
2 subdivision 53 to read as follows:
3 53. The commissioner shall, by rule, establish minimum standards for
4 the maintenance and repair of school buildings so as to provide an
5 appropriate learning environment within each such building.
6 § 2. Subparagraphs (iii) and (iv) of paragraph i of subdivision 2 of
7 section 2023-a of the education law, as added by section 2 of part A of
8 chapter 97 of the laws of 2011, are amended and a new subparagraph (v)
9 is added to read as follows:
10 (iii) in years in which the normal contribution rate of the New York
11 state teachers' retirement system, as defined by paragraph a of subdivi-
12 sion two of section five hundred seventeen of this chapter, increases by
13 more than two percentage points from the previous year, a tax levy
14 necessary for expenditures for the coming fiscal year for school
15 district employer contributions to the New York state teachers' retire-
16 ment system caused by growth in the normal contribution rate minus two
17 percentage points; [and]
18 (iv) a capital tax levy[.]; and
19 (v) a tax levy necessary for expenditures for the maintenance and
20 repair of school buildings.
21 § 3. This act shall take effect on the first of July next succeeding
22 the date on which it shall have become a law, provided that, effective
23 immediately, any rules and regulations necessary to implement the

1 provisions of this act on its effective date are authorized and directed
2 to be promulgated, amended and/or repealed on or before such date; and
3 provided further that the amendments to section 2023-a of the education
4 law made by section two of this act shall not affect the repeal of such
5 section and shall be deemed repealed therewith.
