AN ACT to amend the correction law, in relation to requiring a mental
health medical professional to examine incarcerated individuals in
solitary confinement
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (c) of subdivision 6 of section 137 of the
2 correction law, as amended by chapter 322 of the laws of 2021, is
3 amended to read as follows:
4 (c) Where such confinement is for a period in excess of twenty-four
5 hours, the superintendent shall arrange for a medical professional with
6 an expertise in mental health and for the facility health services
7 director, or a registered nurse or physician's associate approved by the
8 facility health services director to visit such incarcerated individual
9 at the expiration of twenty-four hours and at least once in every twen-
10 ty-four hour period thereafter, during the period of such confinement,
11 to examine into the state of health of the incarcerated individual, and
12 the superintendent shall give full consideration to any recommendation
13 that may be made by the facility health services director for measures
14 with respect to dietary needs or conditions of confinement of such
15 incarcerated individual required to maintain the health of such incar-
16 cerated individual; and
17 § 2. This act shall take effect immediately.
