Directs the department of motor vehicles to maintain an internet link of motor vehicle safety recalls; requires official inspection stations to make an inquiry of such link upon inspection of a vehicle, and if such a recall exists on the vehicle, to advise the owner thereof.

AN ACT to amend the vehicle and traffic law, in relation to the
provision of notice to owners whose motor vehicles are subject to
safety recalls
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 210-a to read as follows:
3 § 210-a. Motor vehicle safety recall information. 1. The department
4 shall make available on its internet website, a link to
5 "http://www.safercar.gov" operated by the National Highway Traffic Safe-
6 ty Administration and providing all motor vehicle safety recalls, based
7 on motor vehicle make, model, year and vehicle identification number,
8 issued by such administration in accordance with the National Traffic
9 and Motor Vehicle Safety Act.
10 2. The department shall promote and provide public notice of the
11 availability of information on motor vehicle safety recalls from the
12 department's website and the National Highway Traffic Safety Adminis-
13 tration at its website: "http://www.safercar.gov". Such promotion and
14 notice shall be provided on the department's internet website and on a
15 separate insert provided to motor vehicle owners upon the issuance or
16 renewal of a registration pursuant to article fourteen of this chapter.
17 § 2. Subdivision (a) of section 304 of the vehicle and traffic law, as
18 amended by chapter 608 of the laws of 1993, is amended and a new subdi-
19 vision (b-1) is added to read as follows:

1 (a) No certificate or certificates of inspection shall be issued by an
2 official inspection station until the mechanisms and other equipment, as
3 specified in subdivision (c) of section three hundred one [(c)] of this
4 [chapter] article, of the motor vehicle inspected are in proper and safe
5 condition and comply with the rules and regulations of the commissioner
6 and with the laws of this state, and the emissions of such motor vehicle
7 conform with subdivision (d) of section three hundred one of this arti-
8 cle and regulations promulgated pursuant thereto at the time the certif-
9 icate is issued.
10 (b-1) An official inspection station shall submit to the department
11 the vehicle identification number of each vehicle subject to inspection.
12 The department, after review of the National Highway Traffic Safety
13 Administration's website "http://www.safercar.gov", shall produce and
14 provide to the official inspection station a vehicle inspection report
15 including a statement of any motor vehicle safety recall or recalls that
16 the motor vehicle is subject to, that such recalls may be repaired by a
17 motor vehicle dealer approved by the manufacturer of the vehicle, and
18 that further information on the recalls may be obtained from the
19 National Highway Traffic Safety Administration on its website:
20 "http://www.safercar.gov". The official inspection station shall deliver
21 such printed vehicle inspection report to the owner of the inspected
22 motor vehicle. If the owner is a dealer, the dealer shall provide such
23 vehicle inspection report to the next retail purchaser or lessee of the
24 motor vehicle.
25 § 3. This act shall take effect on the first of January next succeed-
26 ing the date on which it shall have become a law; provided, however,
27 that effective immediately any and all actions necessary to implement
28 the provisions of this act on its effective date are authorized and
29 directed to be completed by the department of motor vehicles on or
30 before such effective date.
