        AN  ACT  to  amend  the  environmental  conservation law, in relation to
          prohibiting the use of Methoprene
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  33-1301 of the environmental conservation law is
     2  amended by adding a new subdivision 12 to read as follows:
     3    12. For any person to use any pesticide containing the active ingredi-
     4  ent isopropyl(2E, 4E)-11 Methoxy-3, 7, 11 Trimethyl-2, 4  Dodecadienoate
     5  (Methoprene) in any storm drain, conveyance for water or fish habitat in
     6  any municipality adjoining the Long Island Sound and the Atlantic Ocean,
     7  and  their  connecting water bodies, bays, harbors, shallows and marshes
     8  provided, however, an emergency application of  such  pesticide  may  be
     9  made  as determined by the county health department in cases where there
    10  is a significant threat to public health.
    11    § 2. This act shall take effect on January 1, 2020.
