        Introduced  by  Sen.  YOUNG  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Cultural Affairs, Tourism,

        AN ACT to establish a study committee on the housing aspect  of  tourism
          in  the  state  of  New  York; and to amend chapter 225 of the laws of
          2010, amending the multiple dwelling law and the  administrative  code
          of  the  city  of  New  York relating to clarifying certain provisions
          relating to occupancy of class A multiple dwellings,  in  relation  to
          postponing the effective date thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The legislature finds and declares that tourism,  including
     2  tourism  in  the  city of New York, is a vital and important part of the
     3  economy of the state of New York creating thousand of jobs and producing
     4  needed tax revenues both in sales  tax  receipts,  occupancy  taxes  and

     5  income tax revenue. It further finds and declares that an important part
     6  of  the  tourism  industry  in  the city of New York have been rooms and
     7  affordable housing accommodations made available in mixed use  buildings
     8  serving  as  an  alternative  to higher end, more expensive hotels which
     9  some tourists, such as students, simply cannot afford. Furthermore,  the
    10  legislature  also finds and declares that unless alternative, affordable
    11  rooms and affordable housing accommodations  remain  available,  tourism
    12  will  decline,  jobs will be lost and the state during a perilous fiscal
    13  condition will lose revenue and jobs. The legislature finds and declares
    14  that it is important to avoid any change in the current choice of accom-
    15  modations available to visitors of our state until there is  a  thorough
    16  economic  impact study undertaken regarding the role of affordable tour-

    17  ism units and the negative effect that the elimination  of  these  units

     1  could  have  on the economy of the state of New York and the city of New
     2  York.
     3    §  2.  There  is  hereby  established a study committee on the housing
     4  aspect of the tourism industry in the state of New York. Such  committee
     5  shall  consist  of 11 members, who shall serve without compensation. One
     6  member shall be the chair of the senate committee on  cultural  affairs,
     7  tourism,  parks  and recreation or his or her designee. One member shall

     8  be the chair of the assembly  committee  on  tourism,  parks,  arts  and
     9  sports  development  or  his  or  her  designee.  Two  members  shall be
    10  appointed by the temporary president of the senate at least one of  whom
    11  shall have substantial experience in the tourism industry or be a repre-
    12  sentative  of  a  tourism  related  organization.  Two  members shall be
    13  appointed by the speaker of the assembly at least one of whom shall have
    14  substantial experience in the tourism industry or be a representative of
    15  a tourism related organization. One member shall  be  appointed  by  the
    16  minority  leader  of  the  senate.  One member shall be appointed by the
    17  minority leader of the assembly. Two members shall be appointed  by  the
    18  governor.  The commissioner of economic development or his or her desig-
    19  nee shall serve on the committee and act as the chair of the committee.

    20    The committee shall issue a report to the governor, the speaker of the
    21  assembly, the temporary president of the senate, the minority leader  of
    22  the assembly and the minority leader of the senate no later than October
    23  1,  2012 on the role that affordable rooms and affordable housing accom-
    24  modations play in the tourism industry in the state of New York, and the
    25  potential economic impact that could  result  from  the  elimination  or
    26  substantial elimination of consumer choices in the market place.
    27    The  department  of  economic  development  shall  make  its staff and
    28  resources available to the committee to compile the report  as  well  as
    29  the  staff  of  the  division  of the budget. Legislative staff may also
    30  assist in this effort to the extent as  determined  by  the  legislative
    31  leaders.
    32    §  3. Section 8 of chapter 225 of the laws of 2010 amending the multi-

    33  ple dwelling law and the administrative code of the  city  of  New  York
    34  relating to clarifying certain provisions relating to occupancy of class
    35  A  multiple dwellings, as amended by chapter 566 of the laws of 2010, is
    36  amended to read as follows:
    37    § 8. This act shall take effect [May 1, 2011] November  30,  2012  and
    38  shall  apply to all buildings in existence on such effective date and to
    39  buildings constructed after such effective date  except  that  prior  to
    40  such effective date an agency with the duty to enforce the provisions of
    41  the  multiple  dwelling law may promulgate rules and regulations or take
    42  other administrative actions to provide for the registration of dwelling
    43  units in accordance with the provisions of subdivision 16 of section  67
    44  and  title  3  of  article  4  of the multiple dwelling law, as added by

    45  sections two and three of this act, respectively.
    46    § 4. This act shall take effect immediately and  shall  be  deemed  to
    47  have been in full force and effect on and after May 1, 2011.
