        Introduced  by  Sen.  FARLEY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT to amend the public health law, in relation to the  liability  of
          health care practitioner volunteers
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. Subdivision 4 of section 260 of the public health  law,  as
     2  amended  by  chapter  84  of  the  laws  of  2006, is amended to read as
     3  follows:
     4    4. [No health care practitioner volunteer  shall  participate  in  the
     5  health  care practitioner volunteer program established pursuant to this
     6  title unless, with respect  to  acts  and  omissions  that  occurred  or
     7  allegedly  occurred within the scope of his or her participation in such
     8  program, he or she is covered  by  an  adequate  professional  liability
     9  insurance  policy.] A health care practitioner volunteer shall be deemed
    10  to be an "employee" for purposes of  section  seventeen  of  the  public

    11  officers  law  with  respect  to any acts and omissions that occurred or
    12  allegedly occurred within the scope of his or her participation in  such
    13  program.
    14    § 2. This act shall take effect immediately.
